1. About us
APEX Breakout is a TradingView indicator product operated by its founders and sold through Whop at apexbreakout.com. References to we, us or our refer to APEX Breakout. References to you refer to the subscriber or user of our products.
2. Products and access
APEX Breakout is available in three tiers — Lite, Pro and Elite — each granting different levels of access to the indicator on TradingView. Access is granted via TradingView’s invite-only script system and is tied to the TradingView username provided at checkout. Access is personal and non-transferable, each subscription grants access to one username only, and access may be revoked if your subscription lapses or these terms are breached.
3. Subscriptions and payments
Subscriptions are processed and managed through Whop. Monthly subscriptions are billed on a recurring basis until cancelled. Lifetime subscriptions are a one-off payment granting permanent access to the purchased tier. Prices are displayed in GBP and cancellation takes effect at the end of the current billing period.
4. Refund policy
Due to the digital nature of the product and immediate access to TradingView upon purchase, we do not offer refunds on subscriptions or lifetime purchases except where required by law. If you experience a technical issue that prevents access, contact hello@apexbreakout.com and we will resolve it promptly.
5. Not financial advice
APEX Breakout is a technical analysis tool provided for educational and informational purposes only. Nothing on this website, within the indicator or in communications from us constitutes financial advice, investment advice, a recommendation to buy or sell any instrument, a guarantee of outcome, or a representation that any strategy will be profitable.
6. Risk warning
Trading financial instruments including forex, indices, commodities and cryptocurrencies involves substantial risk of loss. Past performance of any strategy, signal or indicator does not guarantee future results. You should only trade with money you can afford to lose and seek independent financial advice if unsure.
7. Alerts and automation
APEX Breakout includes native Pine Script alert functionality and, in the Elite tier, a PineConnector webhook for MT4/MT5 automation. Alert delivery depends on TradingView servers, your internet connection and third-party services. We accept no responsibility for missed alerts, delays or trading decisions made in reliance on automated execution.
8. Intellectual property
All content on this website and within the APEX Breakout indicator — including Pine Script source code, graphics, tutorials and member hub content — is the intellectual property of APEX Breakout. You may not copy, reproduce, distribute, resell, reverse engineer or share access to any part of our products or content.
9. Affiliate programme
Our affiliate programme is operated through Whop. Affiliates earn commission on referred sales subject to Whop’s affiliate terms. Affiliates must not make misleading claims, guarantee trading results or engage in spam. We reserve the right to remove affiliates for breach of these conditions.
10. Limitation of liability
To the fullest extent permitted by law, APEX Breakout and its operators shall not be liable for direct, indirect, incidental, consequential or special damages arising from your use of the product or trading decisions, including trading losses, loss of profits or loss of data. Our total liability shall not exceed the amount you paid us in the three months preceding the claim.
11. Changes to the product
We reserve the right to modify, update or discontinue any aspect of APEX Breakout at any time. We will endeavour to notify subscribers of significant changes. Continued use of the product after changes constitutes acceptance of the updated terms.
12. Governing law
These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
